Limited Liability Indemnity

This page sets out the limits of our liability and your indemnity obligations when you use tritanglasses.com.au or buy from Tritan Glasses, a division of BuyFactory Direct Pty Ltd ("we", "us" or "our"). It forms part of our Terms & Conditions and does not affect your consumer guarantees under the Australian Consumer Law.

Your consumer guarantees come first

Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for your consumer guarantees under the Australian Consumer Law. Where those guarantees apply, they take priority over anything stated here.

Limitation of our liability

Subject to the section above, and to the fullest extent permitted by law:

We are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or goodwill, however it arises.
We are not liable for loss or damage that was not foreseeable, or that was caused by misuse of a product, by failure to follow the care instructions, or by normal wear and tear.
Where we are liable, our maximum aggregate liability to you for any claim connected with an order is limited to the amount you paid for the products in that order.
Should any liability arise, our representatives make no assertion that our products are designed to prevent injury or loss, and we are not responsible for shipping or fulfilment delays, order cancellations or product unavailability.

Website availability

We try to keep the site available and working, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw or change all or part of the site without notice, and we are not liable if it is unavailable at any time. The information on this website is provided in good faith on an "as is" basis; we make no representation or warranty as to its reliability, accuracy or completeness, and do not accept responsibility for errors or omissions.

Your indemnity

You agree to indemnify us against any reasonable losses, costs and claims we incur as a result of your breach of our Terms & Conditions, your misuse of the site, or your infringement of another person's rights through your use of the site.
